Here at Black Diamond Aviation, we are very excited to have you on board with us!
To ensure your travel journey is booked and confirmed, or to help you manage your booking with us, please refer to the below terms and conditions.
DEFINITIONS:
The Company - means Black Diamond Aviation, we, us, our, ourselves.
The Client - means you, your, yourself.
Pilot In Command - means a Pilot that is employed by Black Diamond Aviation at the time of your travel and is the person on board an aircraft who is ultimately responsible for its operation and safety during the flight.
Crew - means a Pilot or an employee that is employed by Black Diamond Aviation at the time of your travel.
Passenger - means any person that has been listed at the time of booking the travel as a passenger to be included on the passenger manifest.
Luggage/Freight/Cargo - means your personal property with you on your trip. It consists of any baggage you bring on board with you.
Check-in Deadline - means the time limit specified by Black Diamond Aviation by which you must have completed your check-in, including dropping off your luggage/freight/cargo.
Events Beyond Our Control - means weather events, air traffic control issues, industrial action, security issues or any other unusual or unforeseen circumstance which we cannot control and the consequences of which we could not have avoided.
Excess payload - means any passenger and/or their luggage/freight/cargo that is in excess of the applicable available payload.
QUOTATIONS:
By confirming and accepting a Black Diamond Aviation quote and initiating the supply of our services, you agree to comply with the terms and conditions set out below and any other terms and conditions agreed in writing. To confirm with us that our quote was successful, you must provide this confirmation to us in writing. Please email: operations@blackdiamondaviation.com.au
Please be advised that our quotes are only valid for the included flight details on the specified date(s) as listed on the quote. Any changes will be subject to a re-quote. Charter rates are only valid at the time of quote and may change without prior notice.
Please note: Quotation is indicative of all operating costs associated with the flight, however, holding due to weather, traffic, military activity or any other event beyond our control is charged accordingly.
WAITING TIMES:
Waiting time is charged at $100.00 per hour + GST.
Where a pilot is required to spend time on the ground waiting for a return journey, an air-conditioned rest area must be provided by the Client for the full duration of the pilot's waiting time.
In the instance that the pilot is required to overnight away from their base, the client must provide the pilot with a private hotel room and meals. Where applicable, Black Diamond Aviation can arrange this on your behalf and include these costs to our quotation of your travel. Normal waiting time is not applied to overnight stays. CONFIRMING YOUR TRAVEL BOOKING:
Quotations are only confirmed when Black Diamond Aviation is in receipt of full payment, unless otherwise authorised by Black Diamond Aviation, or in the instance where the client and/or their organisation has an active account with Black Diamond Aviation.
When booking your travel with Black Diamond Aviation, we ask that you include your purchase order/chargeback/travel warrant documentation to your email. Failure to do this will result in your invoice and/or tax receipt not having the necessary information on it. This does not void your invoice, or make it invalid in any way.
Passenger names, their contact details and luggage/freight/cargo information is critical, and must be supplied at the time of booking your travel.
CHECK IN / ARRIVALS:
Black Diamond Aviation is located at the Gove Airport General Aviation area. Our terminal is next to the CASA building. For your convenience, free parking is available in front of our building.
To assure an on-time departure, passengers will be required to check in no later than 20minutes before their departure time from Gove Airport. If you are departing from a community, you must be at the airstrip 20minutes prior to departure. This will allow your pilot adequate time to finalise all necessary procedures for your flights, including obtaining actual passenger and/or luggage/freight/cargo weights.
Passengers that have bulky items or maximum freight, must give prior notice to Black Diamond Aviation, and check in 45minutes prior to departure.
If you are booking travel with Black Diamond Aviation for your colleagues, it is required that you inform them of our check-in requirements.
Clients who arrive on or after their departure time, may cause their flight to be cancelled. In this instance the travelling passengers will be classified as a no-show and the full charter cost will be applied.
AVAILABLE PAYLOAD:
We are committed to safety first, and for this reason, our fleet of twin engine aircraft (Cessna310's and Beechcraft Baron 55's) offer an available maximum payload of 380kgs - 400kgs.
This payload will vary and is largely depended on the actual passenger and/or luggage/freight/cargo weights, fuel requirements and the length of the airstrip (at both the departure and arrival airports).
Black Diamond Aviation strictly follow the laws and regulations as set out by CASA (Civil Aviation Safety Authority) and may require our clients to provide us with approximate weights for passengers and their luggage/freight/cargo (in kilograms) ahead of time. It is important that all luggage/freight/cargo fit within the physical dimensions of the aircraft baggage area(s). Once the aircraft baggage storage area(s) have reached capacity, it is deemed that the payload has been achieved regardless of the available payload in kilograms quoted.
Further to the above and in-line with providing a safe working environment for our crew, is important that no one bag or box weighs in excess of 20kgs. Any bag or box that is in excess of 20kgs will not be able to be loaded into our aircraft by our crew, and will have to be repacked into small bags or boxes.
The safe carriage of passengers and their baggage/freight/cargo is always at the sole discretion of the Pilot In Command.
It is important to note that the quoted payload may not be exceeded by the client or any other person. In the instance where passengers and/or their luggage/freight/cargo are in excess of the quoted payload, Black Diamond Aviation reserves the right to arrange a second aircraft for the client, departing at a time and on a date that our schedule reasonably allows, at the full cost of the client.
CANCELLATIONS:
All bookings can be cancelled, however some bookings may attract cancellation fees and charges. For more information, please refer to the below:
Cancellation of a confirmed charter flight(s) must be in writing. Please email: operations@blackdiamondaviation.com.au
Following your email, we will respond with a confirmation email to inform you that your booking has been cancelled on our end. If you do not receive this confirmation email within 24hours, please contact our Operations team on 0413 443 544 or 0428 514 643.
Please note, in the event that a confirmed booking is cancelled the following scale of charges will apply:
~Once confirmed, but more than 3 full days prior to the departure date: NO CHARGE will apply.
~Between 72 and 24 hours of departure: 30% of TOTAL COST.
~Within 24 hours of departure: 50% of TOTAL COST
~Failure to travel (no show): 100% of TOTAL COST
REFUSAL OF CARRIAGE AND CANCELLATION BY BLACK DIAMOND AVIATION:
Black Diamond Aviation reserves the right to refuse access to our aircraft to any person in accordance with various Civil Aviation Safety regulations. In addition to this, Black Diamond Aviation also reserves the right to refuse carriage of any passenger that is intoxicated, disorderly, abusive, pose a risk to flight safety and/or if a Black Diamond Aviation crew member deem the passenger unfit to travel.
Should this occur, Black Diamond Aviation reserves the right to cancel the flight and will pass the full cost of the flight on to the client for immediate payment.
DELAYS AND CHANGES BY BLACK DIAMOND AVIATION:
Black Diamond Aviation is committed to your safety first. It will always be our number one priority and at times we will make operational decisions that affect your flight to ensure your safety.
Although we will make every effort, using all the available information to us at the time, to get you to your destination, there may be certain conditions that prevent this, including but not limited to, weather and the condition of an airstrip. Where an aircraft has departed, but has not been able to reach its destination, and returns to its departure point or is diverted to another port, payment in full for the affected flight will still be required, regardless of whether the pilot of our Operational Team was able to communicate this to you.
Black Diamond Aviation reserves the right to change and substitute aircraft, aircraft type and registration without prior notice to the client. Black Diamond Aviation reserves the right to cross hire aircraft and crew, including any other necessary staff without prior notice to the client.
Black Diamond Aviation reserves the right to cancel a booking in the event that an aircraft becomes unserviceable and/or unavailable before or during a flight, and/or if an unforeseen situation where crew member prevents the flight from being carried out.
Black Diamond Aviation reserves the right to cancel, postpone or re-direct any flight due to the following reasons that include (but may not be limited to) war, warlike events, strikes, civil war, civil unrest, riots, sabotage, quarantine, hijacking, terrorist actions, weather conditions, any technical reasons, detention or any similar measures, accidents with any of our aircraft, any factors that may make any crew member reasonably believe that their safety, the safety of their passengers or the safety of their aircraft is in any danger, any other force majeure of any nature that Black Diamond Aviation has no control over, including any act of God.
Black Diamond Aviation accepts no responsibility for any cost incurred by passengers for any cancellations, delays, redirections or changes to flights.
INVOICES AND PAYMENTS:
Black Diamond Aviation requires payment for services provided no later than 48 hours prior to the departure date, unless other arrangements have been made directly with Black Diamond Aviation or where the client and/or their organisation has an active account with Black Diamond Aviation.
Payment can be made via EFT or Credit Card (Visa and MasterCard ONLY).
A 1.5% credit card surcharge applies on the grand total of your invoice when paying with a credit card.
For clients who have an account with us, we ask that you kindly pay your invoice by the due date listed on your invoice.
An additional 1.5% finance change will be applied to unpaid invoices exceeding the payment terms.
Important to note for all clients: invoice queries will only be recognised if submitted within 7 days from the date of invoice.
